Why Serving Your Response Matters

If you have been served a protection order petition in Snohomish County, responding properly may be essential so you can protect your rights. For the judge to consider your version of events, the Petitioner—the person who filed the protection order—may need to receive a copy of your response materials before the hearing.

While serving your response on the Petitioner ahead of time is not always required, it may be strongly recommended. If the Petitioner does not get your documents in advance, the judge may postpone the hearing to give them time to review what you have submitted. This can delay resolution for both parties. For this reason, timely service benefits your case.

Can I Serve My Own Response?

You are not allowed to serve these documents yourself. Washington law requires that papers be served by an adult (over 18) who is not a party to the case. You have several options:

  • Professional Process Server: County-registered experts who know how to serve legal documents properly the first time.
  • Friend or acquaintance: Any adult not involved in the case can serve papers as long as they know the ins and outs of proper service in Washington. Does your friend plan on leaving the papers on the porch if there is no answer? Is this allowed?
  • Sheriff’s Office: Law enforcement may provide process service for a fee. Keep in mind that the sheriff typically only serves during business hours which does not include weekends, and there may be a long wait time for them to get to serving your papers. Additionally, they only serve specific types of documents.

As a best practice, consult your documents or the court clerk to determine the deadline for the Petitioner getting served with your response. It is imperative to communicate this deadline to the person that will be serving your protection order response paperwork.
